Guideline 5.3.4 - Legal: Real-Money Gambling Without Required Licensing

The licenses must be for the specific entity submitting the app — not a parent company, affiliate, or white-label provider, unless the submitting entity is explicitly named on the license. Additionally, the app must be free on the App Store. Users can deposit money within the app, but the app itself cannot have a purchase price. Apple also requires that all gambling apps clearly state the odds and rules, provide responsible gambling resources, and comply with local advertising regulations.
Resolution Guide
**Obtain gambling licenses** — Apply for gambling licenses in every jurisdiction where the app will be available. This process varies by jurisdiction and can take weeks to months. Common jurisdictions: UK (Gambling Commission), Malta (MGA), Gibraltar, Isle of Man, specific US states.
**Implement geo-restriction** — Use GPS, IP geolocation, and carrier detection to restrict the app to licensed jurisdictions only. Implement server-side verification — client-side only is insufficient.
**Make the app free** — Set the App Store price to free ($0.00). In-app deposits and wagers are handled within the app, not through the purchase price.
**Add license display** — Show your gambling license number, issuing authority, and regulatory information in the app's About/Legal section. Include links to responsible gambling resources.
**Document everything in review notes** — Attach: (a) gambling license copies for each jurisdiction, (b) list of jurisdictions where the app is available, (c) description of geo-restriction implementation, (d) responsible gambling features.
**Submit as an organization** — Gambling apps must be submitted by the licensed entity's organization developer account, not an individual account.
